These Terms of Service (“Terms”) govern your use of adf-ws.com, our online forms and the ADF worker and referrer portal (together, the “Services”), operated by ADF Workforce Solutions, LLC (“ADF,” “we,” “us”). By using the Services, you agree to these Terms. If you do not agree, do not use the Services.
1. Eligibility
You must be at least 18 years old to submit an application, request staff or use the portal. If you use the Services for a company, you confirm that you are authorized to act for it.
2. Our Services
The website describes our staffing services and allows employers to request personnel and job seekers to apply. Submitting a request or application does not create an employment relationship, a staffing agreement or any obligation to provide or accept services. Placements are governed by separate written agreements with clients and by employment documents with workers.
3. No guarantee of employment
Applying does not guarantee a job, an assignment, a number of hours or a rate of pay. Unless a written agreement signed by an authorized ADF officer states otherwise, employment with ADF is at-will, meaning either you or ADF may end it at any time, with or without cause or notice, as permitted by law.
4. Equal employment opportunity
ADF is an equal opportunity employer. We do not discriminate on the basis of race, color, religion, sex (including pregnancy), sexual orientation, gender identity, national origin, age, disability, genetic information, veteran or military status, or any other status protected by federal, state or local law. Applicants who need a reasonable accommodation in the application process may contact us.
5. Accurate information
You agree to provide information that is true, current and complete, and to update it when it changes. Do not submit another person’s information without their permission. False or misleading information may result in rejection of an application or termination of employment.
6. Portal accounts and security
- Portal logins are issued by ADF to a specific person. Do not share your username or password, and change any temporary password the first time you sign in.
- You are responsible for activity under your account. Notify us immediately of any unauthorized use.
- Hours, pay and commission figures in the portal are shown before taxes and deductions. Unpaid amounts are estimates. Official records are your pay statements and ADF’s payroll records. Tell us promptly if anything appears incorrect.
- Portal access ends two weeks after your assignment or the last referred worker’s assignment ends. You may request copies of your records afterward.
- We may suspend or end access to protect the Services, other users or ADF.
7. Acceptable use
You agree not to: access accounts or information that are not yours; probe, scan or test the security of the Services; interfere with or disrupt the Services; upload malicious code; use automated means to collect data; send spam; impersonate any person; or use the Services for any unlawful purpose.
8. Your submissions
By submitting information through the Services, you allow ADF to use it to provide the Services and as described in our Privacy Policy. Do not send confidential information of any third party.
9. Documents and content
Documents offered for download (for example, policies, acknowledgments and blank forms) are provided for ADF applicants, employees, workers and referrers. Website summaries are for convenience only; the signed English-language documents are the official versions and control in case of any difference, including translations. The website’s text, design, logo and photographs are owned by ADF or used with permission and may not be copied for commercial use without our written consent.
10. Third-party links
The Services may link to websites we do not control. We are not responsible for their content or practices.
11. Disclaimers
THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT PERMITTED BY LAW, ADF DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. We do not warrant that the Services will be uninterrupted, error-free or free of harmful components.
12. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, ADF AND ITS OWNERS, OFFICERS, EMPLOYEES AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR LOST PROFITS OR DATA, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICES. ADF’S TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE WEBSITE OR PORTAL WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100). Nothing in these Terms limits rights you have under employment or wage laws that cannot be waived, or liability that cannot be limited by law.
13. Indemnification
You agree to indemnify and hold harmless ADF from claims, losses and expenses (including reasonable attorneys’ fees) arising from your misuse of the Services or violation of these Terms.
14. Governing law and venue
These Terms are governed by the laws of the State of Georgia and applicable federal law, without regard to conflict-of-law rules. Any dispute about these Terms or the website will be brought in the state or federal courts located in Georgia, and you consent to their jurisdiction. Employment-related disputes are governed by your employment documents and applicable law.
15. General
If any provision of these Terms is found unenforceable, the rest remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms; we may assign them in connection with a business transfer. These Terms, together with the Privacy Policy and SMS Terms, are the entire agreement about the website and portal.
16. Changes and contact
We may update these Terms; the effective date at the top shows the latest version, and continued use means you accept the changes. Questions: (470) 883-2546 · adf.angieyou@adf-ws.com. See also our Privacy Policy and SMS Terms.
