ADF Workforce Solutions, LLC (“ADF,” “we,” “us,” or “our”) is a Georgia staffing company that places safety, skilled-trade, production and general-labor personnel at client worksites. This Privacy Policy explains how we collect, use, share and protect personal information through adf-ws.com, our online forms, our worker and referrer portal, and the text messages and emails we send (together, the “Services”).
1. Scope
This policy applies to job applicants, employees and assigned workers, referrers, client contacts and website visitors. It does not cover websites or services of our clients or other third parties, even if linked from our website. Additional notices may apply during hiring or employment, such as background-check disclosures, I-9 and E-Verify notices, and policies in the Employee Handbook; where they are more specific, they control.
2. Information we collect
Information you give us
- Applicants: name, mobile phone number, states where you can work, jobs you are interested in, certifications, languages and proficiency, confirmation that you are 18 or older and authorized to work in the United States, and your choice about text messages, together with the date and time of that choice.
- Client contacts: company name, job-site location, roles and headcount requested, start date, contact name, phone number or email, and preferred callback language.
- Employees and assigned workers: information needed to hire, place and pay you, such as contact details, worksite, start and end dates, schedule, hours worked, pay rate, pay-period summaries, and the status of onboarding items such as drug tests, background checks and I-9 / E-Verify.
- Referrers: name, contact details, the agreed commission rate, and the hours of workers you referred.
- Communications: the content of messages, calls and emails you exchange with us.
Information collected automatically
- Server and security logs, including IP address, browser type, pages requested and the date and time of access.
- Cookies that are strictly necessary to sign you in to the portal and keep the website secure. We do not use advertising cookies or cross-site tracking, and we do not sell or share personal information for targeted advertising.
- Your language choice on the website, stored only in your own browser.
- Web fonts are delivered by Google Fonts, which receives your IP address when a page loads under Google’s own privacy policy.
Information from others
We may receive information from clients (for example, timekeeping records from worksite badge or fingerprint readers), background-check and drug-testing providers you authorize, references you list, and referrers who introduce you to us.
Sensitive information
We do not ask for Social Security numbers, bank account numbers, government ID copies or medical information through the website. When the law or onboarding requires them, we collect them through secure hiring and payroll channels, and use them only for those purposes.
3. How we use information
- To review applications, match people with jobs, and contact you about openings, interviews, onboarding, shifts and assignments.
- To respond to and fulfill staffing requests from clients.
- To verify eligibility, conduct lawful screening, and meet safety and site-access requirements.
- To record time, calculate wages, overtime and referral commissions, process payroll, and show you your own records in the portal.
- To comply with employment, tax, immigration, insurance, safety and record-keeping laws, and to respond to lawful requests.
- To protect our people, clients, website and business, including preventing fraud and misuse.
- To improve our Services, using information in aggregated or de-identified form where possible.
4. How we share information
- Clients: when we propose or assign you to a client, we share the information the client reasonably needs for that placement, such as your name, qualifications, schedule and hours.
- Service providers that act on our behalf under written confidentiality obligations, such as website hosting, email and text-message delivery, payroll and tax processing, background-check and drug-testing vendors, insurance carriers, and professional advisers.
- Referrers see only the names, worksites and hours of the workers they referred and their own commission. They never see a worker’s pay.
- Legal and safety: to comply with law, regulation, subpoena or court order; to respond to government agencies; to enforce our agreements; or to protect the rights, property or safety of any person.
- Business transfers: in connection with a merger, acquisition or sale of assets, subject to this policy.
We do not sell personal information. No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Text-messaging opt-in data and consent are not shared with any third parties, except service providers that deliver our messages.
5. Text messages
If you opt in, we use your mobile number to send job and shift messages as described in our SMS Terms. Consent is not a condition of applying, being hired or being placed. Reply STOP to opt out at any time.
6. How long we keep information
- Applicant information: up to three years after your last application or contact, unless you become an employee.
- Employment, time, payroll and tax records: for the periods required by federal and state law (generally at least four years after the record is created).
- Referral commission records: at least four years after payment.
- Portal access ends two weeks after your assignment ends, but the underlying records are kept as stated above.
When information is no longer needed, we delete it or make it de-identified.
7. How we protect information
We use encrypted connections (HTTPS), role-based access so each person sees only what their role allows, logging of administrative changes, and regular backups. No system is completely secure. Keep your password private, sign out on shared devices, and tell us right away if you believe your account has been compromised.
8. Your choices and rights
You may ask us to access, correct or delete your personal information, or to stop contacting you. Depending on your state of residence, you may also have rights under that state’s privacy law, such as the right to obtain a copy of your information, to opt out of certain processing, and to appeal our decision on your request. We will not discriminate against you for exercising these rights.
To make a request, contact us using the details below. We will verify your identity before acting, may ask an authorized agent for proof of authority, and will respond within the time the law requires (generally within 45 days). If we deny a request, we will explain why and how to appeal. Some information must be kept to meet legal obligations, and deleting it may end your ability to use the portal.
9. Children
The Services are not directed to children under 13, and we do not knowingly collect their information. We place only workers who are 18 or older.
10. Equal opportunity
Information about race, sex, disability, veteran status or other protected characteristics, if collected for government reporting, is voluntary, kept separately and never used in hiring decisions.
11. Changes to this policy
We may update this policy. The effective date at the top shows when it last changed. Material changes will be posted on this page before they take effect.
